These Terms of Service (“Terms”) govern your access to and use of the Caliber service, operated by Elevated Development LLC (“Elevated,” “we,” “us,” or “our”). By creating an account or using the service, you agree to these Terms. If you don't agree, don't use the service.
Caliber Career (“The Career Journal”; referred to as “Caliber” throughout these Terms) is a career-intelligence subscription service. You provide information about your work history; we use large language models to produce tailored resumes, cover letters, interview preparation materials, pitches, and related outputs from that information.
You must be at least 18 years old and legally able to enter a binding contract to use Caliber. You must provide accurate account information and keep your login credentials confidential. You are responsible for all activity on your account.
We may refuse service, terminate accounts, or remove content at our discretion if we believe you have violated these Terms.
Content you upload, paste, or speak into Caliber (“Your Content”) remains yours. By using Caliber, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Your Content solely to operate and improve the service for you. We do not sell Your Content. We do not use Your Content to train AI models.
You represent that Your Content is accurate, doesn't infringe anyone else's rights, and that you have the right to provide it to us.
Caliber produces resumes, cover letters, and other documents generated by large language models (“Generated Output”). Generated Output is provided to you to use in your job search. You own the Generated Output you receive, subject to your continued compliance with these Terms.
Large language models can produce inaccurate, outdated, or inappropriate content. You are solely responsible for reviewing every piece of Generated Output before using it in any application, submission, interview, or communication. Caliber does not guarantee that Generated Output is accurate, complete, error-free, or suited to any particular purpose.
Generated Output is not legal, medical, financial, tax, or professional advice and should not be relied upon as such.
Caliber is a tool that helps you prepare job-search materials. We do NOT guarantee that using Caliber will result in interviews, job offers, employment, promotions, raises, or any other outcome. Employment decisions are made by employers based on many factors outside our control.
You agree that Elevated Development LLC is not responsible for employment outcomes, lost opportunities, rejections, withdrawn offers, or any other consequence of your job search, regardless of whether Caliber materials were used.
Caliber offers three paid subscription options: Journal Mode ($15/month), Active Search ($39/month), and Focused Search ($129 for a single 4-month term, priced at a commitment discount relative to monthly Active Search). Prices are listed on the pricing page and may be changed with 30 days' notice via email or in-app notification for renewals or new purchases occurring after the change.
Auto-renewal notice (monthly tiers). Journal Mode and Active Search subscriptions renew automatically at the end of each billing period at the then-current rate for the tier you selected. You will be charged to the payment method on file. To avoid renewal, cancel before the period ends via Settings or the Stripe-hosted billing portal. Cancellation takes effect at the end of the current billing period; you keep access until that period ends.
Focused Search terms. Focused Search is a single upfront payment for a 4-month term and does not auto-renew. When the 4-month term ends, your account drops to Journal Mode at $15/month (which does auto-renew until cancelled). You may purchase another Focused Search term at any time.
Refunds. We offer a 14-day refund window on any paid subscription. To request a refund, email us within 14 days of the charge; no explanation is required. Refunds are not available after 14 days except where required by law.
Chargebacks. If you dispute a charge with your card issuer without contacting us first, we may suspend or terminate your account while the dispute is under review.
Taxes. Listed prices do not include applicable sales taxes. You are responsible for any taxes assessed on your subscription.
Caliber relies on third-party providers to operate. Your content and usage data are shared with them only as needed to provide the service:
Your use of Caliber is also subject to the terms and privacy policies of these providers. We are not responsible for the availability, practices, or policies of third-party services.
You can delete your account at any time from Settings. When you do:

We aim for high availability but don't guarantee uninterrupted service. We may modify, suspend, or discontinue features with or without notice. For material changes to these Terms or to pricing for your tier, we will notify you at least 30 days in advance via email or in-app notice.
You may stop using Caliber at any time. We may suspend or terminate your account for violation of these Terms, fraud or chargeback abuse, or inactivity of more than 24 months. On termination, your access ends and your data enters the deletion window described in Section 8.
Sections of these Terms that by their nature should survive termination (including Sections 4, 5, 12, 13, 14, 15, 16) will survive.
CALIBER IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATED DEVELOPMENT LLC DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATED DEVELOPMENT LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST OPPORTUNITIES, LOST JOBS, LOST WAGES, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless Elevated Development LLC and its officers, employees, and agents from any claim, loss, or expense (including reasonable attorney's fees) arising from: (a) your use of the service, (b) Your Content, (c) your violation of these Terms, (d) your use of Generated Output in job-search or other submissions, or (e) your violation of any law or third-party right.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules.
Binding arbitration.Any dispute arising out of or related to these Terms or the service will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be held in Baltimore County, Maryland, or by remote proceeding at the arbitrator's discretion. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. Disputes may only be resolved on an individual basis. You and Elevated Development LLC both waive any right to participate in a class action, class arbitration, or representative proceeding.
This arbitration clause does not apply to: (a) small-claims court actions, (b) injunctive relief for intellectual property infringement, or (c) any right you have that by law cannot be waived.
The Caliber service, including its software, design, prompts, trademarks, and all other materials (except Your Content and the Generated Output you receive) is owned by Elevated Development LLC or its licensors and is protected by intellectual property laws.
Any feedback or suggestions you send us about the service (“Feedback”) may be used by us without obligation or compensation. You grant us a perpetual, royalty-free, worldwide license to use Feedback for any purpose.
We may update these Terms from time to time. For material changes we will notify you at least 30 days in advance via email or in-app notification. Your continued use of the service after the effective date of changes constitutes acceptance of the updated Terms. If you don't agree to updated Terms, stop using the service and delete your account before the effective date.
Entire agreement. These Terms, along with our Privacy Policy, constitute the entire agreement between you and Elevated Development LLC regarding the service and supersede any prior agreements.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
No waiver.Our failure to enforce a right under these Terms doesn't waive that right.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate, acquirer, or successor in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for failures caused by events outside our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government action, utility failures, or internet outages.
Notices. We may send notices to you via email to the address on your account or via in-app notification. Notices to us should go to the email listed on the signup page.
